A review of the authorities on the wasted costs jurisdiction pursuant to s.51(6) of the Senior Courts Act 1981, including a reminder (of wider application) that ‘a solicitor has a regulatory and legal duty to uphold any arguable rights of legal professional privilege the client … may have’ and ‘the significant risk of own interest conflict…means a solicitor cannot advise his client on either (i) whether rights of privilege subsist, or (ii) whether to waive any rights of privilege that do subsist.
